1. Acceptance of Terms

By accessing or using the MotaVation website (the “Site”), purchasing products, or otherwise using our services, you agree to be bound by these Terms of Service, our Refund & Return Policy, Shipping Policy, Privacy Policy, and any additional policies referenced on the Site.

If you do not agree with these Terms, please do not access or use the Site or purchase products through the Site.

2. Eligibility

Age Requirement: You must be at least 21 years of age to access or purchase age-restricted hemp-derived products offered through the Site. By placing an order, you represent and warrant that you are at least 21 years old.

Geographical Limitations: Products are offered and shipped only to locations within the United States where the applicable product may lawfully be sold, possessed, and delivered.

Legal Compliance: By accessing the Site or purchasing a product, you agree to comply with all applicable federal, state, and local laws and regulations. MotaVation reserves the right to restrict or refuse sales or shipments to any jurisdiction where a product is prohibited or where MotaVation determines that additional restrictions are appropriate.

3. Use of the Website

Limited License: MotaVation grants you a limited, revocable, non-exclusive, and non-transferable license to access and use the Site for lawful, personal, and non-commercial purposes.

Prohibited Conduct: You may not misuse the Site. Prohibited activities include, but are not limited to:

  • Attempting to interfere with the operation, security, or integrity of the Site;

  • Engaging in fraudulent or deceptive activity;

  • Providing false information regarding your age, identity, shipping address, or payment information;

  • Attempting to gain unauthorized access to the Site or its systems;

  • Reverse-engineering or attempting to extract source code from any portion of the Site except where expressly permitted by law; or

  • Using the Site or its products in violation of applicable law.

4. Product Information, Cannabinoid Content, and Certificates of Analysis

MotaVation strives to provide accurate and current information regarding the products offered through the Site.

Cannabinoid Disclosure: Applicable hemp-derived product pages will clearly display the product’s THCA content and Delta-9 THC content as percentages, based on the applicable Certificate of Analysis (“COA”).

Certificates of Analysis: Products requiring laboratory testing will have the applicable COA made available directly on the product page or through a link that remains on the MotaVation website domain. COAs will not redirect customers to Google Drive or another unauthorized third-party file-hosting location.

Where a product is offered in multiple flavors or variants that have separate laboratory results, the applicable COA will be provided for each flavor or variant.

Product cannabinoid information displayed on the Site is intended to reflect the corresponding laboratory results. Natural variations, testing methodologies, manufacturing tolerances, and other factors may result in differences between batches.

5. Hemp-Derived Product Compliance

Products represented as federally compliant hemp products are intended to contain no more than 0.3% hemp-derived Delta-9 THC by dry weight, as applicable under federal law.

MotaVation does not represent that every product is lawful in every state or locality. State and local laws concerning hemp-derived cannabinoids, including THCA, Delta-8 THC, and other cannabinoids, vary and may change.

Customers are responsible for complying with applicable laws regarding the purchase, possession, and use of products available through the Site.

MotaVation reserves the right to modify shipping restrictions, product availability, or order eligibility at any time in response to changes in applicable laws, regulations, carrier requirements, or company policy.

6. Shipping Restrictions

MotaVation does not knowingly ship products into jurisdictions where the applicable product is prohibited.

THCA Product Shipping Restrictions

THCA products are not available for shipment to:

Arkansas, Hawaii, Idaho, Kansas, Louisiana, Oklahoma, Oregon, Rhode Island, Utah, and Vermont.

All applicable products contain less than 0.3% hemp-derived Delta-9 THC in compliance with applicable federal hemp requirements.

Delta-8 Product Shipping Restrictions

Products containing Delta-8 THC are not available for shipment to:

Alaska, Arizona, California, Colorado, Connecticut, Delaware, Hawaii, Idaho, Iowa, Massachusetts, Michigan, Minnesota, Mississippi, Montana, Nevada, New Hampshire, New York, North Dakota, Oregon, Rhode Island, Utah, Vermont, Virginia, Washington, and West Virginia.

These restrictions may be updated at any time to reflect changes in applicable laws or regulations.

7. Product Catalog and Availability

All products are subject to availability.

MotaVation may add, remove, limit, or discontinue products or product variants at any time without prior notice.

Products offered through the Site are limited to products authorized for sale through MotaVation’s online catalog. Tobacco products, including cigars and other tobacco products, are not offered for sale through the Site.

MotaVation reserves the right to limit the number of products, variants, or SKUs offered through the Site to comply with applicable operational, payment-processing, regulatory, or compliance requirements.

8. Orders

Order Acceptance: Submission of an order does not constitute acceptance by MotaVation. All orders are subject to availability, payment verification, age verification where applicable, shipping eligibility, and compliance review.

MotaVation reserves the right to refuse, limit, or cancel any order at its discretion, including orders that cannot legally be shipped to the customer’s destination.

If an order is canceled after payment has been processed, any refund due will be handled in accordance with the applicable Refund & Return Policy.

Final Sales: Except as otherwise required by law or expressly provided in our Refund & Return Policy, sales are final.

9. Payment Terms

Payment Methods: MotaVation accepts the payment methods displayed at checkout. You agree to provide accurate, current, and complete billing and payment information.

Pricing: Prices and product availability are subject to change without notice. Applicable taxes, shipping charges, and other disclosed fees may be added at checkout.

Payment Security: Payment information may be processed by third-party payment processors using their respective security measures and policies. MotaVation is not responsible for unauthorized use of payment credentials resulting from circumstances outside MotaVation’s reasonable control.

10. Shipping and Delivery

MotaVation ships only to eligible destinations within the United States.

Estimated processing and delivery times displayed on the Site are estimates and are not guaranteed.

MotaVation may refuse or cancel shipment when an order cannot legally or operationally be delivered to the requested destination.

To report a damaged, incorrect, or otherwise qualifying order issue, customers must contact MotaVation within the timeframe specified in the Refund & Return Policy.

11. Intellectual Property

Unless otherwise indicated, the Site and its content—including text, graphics, logos, branding, photographs, product information, software, and other materials—are owned by or licensed to MotaVation and are protected by applicable intellectual-property laws.

You may not copy, reproduce, modify, distribute, publish, sell, license, or commercially exploit Site content without prior written authorization from MotaVation, except as otherwise permitted by law.

12. Health and Medical Disclaimer

Products offered through the Site are not intended to diagnose, treat, cure, or prevent any disease.

Statements regarding products offered through the Site have not necessarily been evaluated by the U.S. Food and Drug Administration.

Information presented on the Site is provided for general informational purposes and is not medical advice.

Consult an appropriate healthcare professional before using hemp-derived cannabinoid products, particularly if you take medication, have a medical condition, are pregnant or nursing, or have concerns regarding potential interactions or effects.

Do not drive, operate machinery, or engage in activities requiring full alertness while impaired.

Keep all products securely stored and out of reach of children and pets.

13. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE, ITS CONTENT, AND PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

MOTAVATION DISCLAIMS ALL WARRANTIES TO THE EXTENT PERMITTED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded or waived.

14. Customer Responsibility and Legal Compliance

Laws governing hemp-derived cannabinoids may differ among federal, state, and local jurisdictions and may change over time.

Customers are responsible for determining whether the purchase, possession, use, or delivery of a particular product is lawful in their jurisdiction.

The availability of a product on the Site does not constitute legal advice or a representation that the product is lawful in every jurisdiction.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOTAVATION AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF THE SITE OR PURCHASE OR USE OF PRODUCTS.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

16. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless MotaVation and its owners, officers, employees, agents, affiliates, and service providers from claims, liabilities, damages, losses, and reasonable expenses, including legal fees, arising from your unlawful use of the Site, violation of these Terms, or violation of applicable law or the rights of another person.

17. Governing Law and Dispute Resolution

Governing Law: These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable federal law controls.

Venue: To the extent permitted by applicable law, disputes arising from or relating to these Terms, the Site, or purchases made through the Site will be brought in a court of competent jurisdiction located in Texas.

18. Changes to These Terms

MotaVation reserves the right to modify these Terms from time to time.

When material changes are made, the revised Terms will be posted on the Site and the “Last Updated” date will be updated accordingly.

Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

19. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
